Terms and Conditions

1. Introduction 1.1 These Terms and Conditions (“Terms”) govern the relationship between MADA EDUCATION SERVICES SDN. BHD. (“the Company”, “Mada”, “we”) and anyone who uses its website or requests or receives its services. 1.2 The Company is a private limited company registered in Malaysia, located at Kenwingston, Persiaran Bestari, 63000 Cyberjaya, Selangor, Malaysia. 1.3 The Company provides advisory, support and administrative services to students who wish to study in Malaysia. The Company is not a university, an educational institution or a government authority, and has no power to issue admission, visa, pass or any academic decisions. 1.4 By using the website or requesting any service, you confirm that you have read, understood and agreed to these Terms. If you do not agree, please do not use the website or request the services. 1.5 These Terms are read together with the Company’s Privacy Policy and form one agreement. 2. Definitions • Company: MADA EDUCATION SERVICES SDN. BHD. • Student, Client or “you”: the person requesting or receiving the services, including their parent, guardian or authorised representative when acting on their behalf. • Parent/Guardian: the parent or legal guardian of a student under 18 years of age. • Educational Institution: any university, college, language institute or other educational institution in Malaysia to which the student applies. • Government Authorities: any competent official body in or outside Malaysia, including immigration and student pass authorities, embassies, consulates, attestation and scholarship bodies. • Third Party: any person or entity other than the Company and the student, including educational institutions, government authorities, landlords, and telecommunications, insurance and banking providers. • Services: the services described in clause 3. • Website: madaedu.com and any official digital accounts or channels of the Company. • External Costs: any fees or amounts charged by a third party, such as application, tuition, visa, medical, insurance, accommodation and telecommunications fees. 3. Scope of Services 3.1 The Company itself provides the following services, according to each student’s needs: • Advice and guidance on choosing an educational institution and programme. • Information on admission requirements and on studying and living in Malaysia. • Preparing applications and reviewing and organising documents. • Submitting applications to educational institutions on the student’s behalf, with the student’s authorisation. • Following up applications and coordinating with educational institutions and relevant bodies. • Assistance with registration after admission. • Assistance with Student Pass and visa procedures. • Assistance with arranging accommodation. • Airport reception and transport. • Assistance with post-arrival matters such as insurance, SIM cards and bank accounts. 3.2 Information the Company provides about institutions, programmes, fees and requirements is for guidance, is drawn from those bodies’ sources, and may change without notice. The official announcements of the educational institution or competent government authority prevail. 3.3 The Company does not provide legal or immigration law advice and does not guarantee the equivalency or recognition of qualifications in the student’s home country. The student is responsible for verifying that the competent authorities in their country recognise the chosen institution and programme. 4. Nature of the Relationship 4.1 The Company acts as an independent provider of advisory, support and administrative services. These Terms do not create a partnership, employment or general agency relationship, except within the written authorisation the student gives the Company to submit and follow up applications on their behalf. 4.2 The Company may have cooperation agreements with some educational institutions. This does not affect the student’s freedom of choice and does not result in any fees for the student. 4.3 The final decision on choosing an institution and programme and accepting any offer rests with the student alone. 5. Eligibility and Students Under 18 5.1 The student must be at least 18 years old or deal with the Company through their parent or guardian. 5.2 If the student is under 18, their parent or guardian must agree to these Terms and the Privacy Policy, sign the authorisation form, and be responsible for the obligations in them. The Company will involve the parent or guardian in material decisions concerning the student. 5.3 The Company may request proof of age, identity, guardianship or authorisation. 6. Requesting Services and Authorisation 6.1 Services may be requested through the website forms, WhatsApp, email or a visit to the Company’s office. 6.2 The student, or their parent or guardian, must sign an authorisation form allowing the Company to communicate with educational institutions and relevant bodies on their behalf within the scope of the requested services. 6.3 The Company may decline to provide services to any student at its reasonable discretion, including where requirements are not met or incorrect information is provided. 7. Company Obligations The Company will: 7.1 Provide the services with reasonable care and professionalism. 7.2 Provide information that is as accurate as possible based on official sources available at the time. 7.3 Inform the student of material developments in their application within a reasonable time. 7.4 Not submit any application or document on the student’s behalf without their consent. 7.5 Handle the student’s data in accordance with the Privacy Policy and applicable law. 7.6 Not give any promise or guarantee of admission, visa or scholarship. 8. Student Obligations The student will: 8.1 Provide true, complete and current information and documents within the required deadlines. 8.2 Respond promptly to requests from the Company, educational institutions and government authorities. 8.3 Review applications and documents prepared on their behalf before submission and report any error immediately. 8.4 Pay external costs on time. 8.5 Read and comply with the requirements of educational institutions and government authorities, including residence, study and attendance conditions. 8.6 Inform the Company immediately of any change in their details or circumstances, or if they apply to the same institution directly or through another party. 8.7 Comply with the laws and regulations of Malaysia while residing there. 9. Accuracy of Information and Documents 9.1 The student alone is responsible for the truth, accuracy and completeness of the information and documents they provide. 9.2 The Company does not verify documents as an official body and is not responsible for any consequences of incorrect, forged or incomplete information or documents. 9.3 If the Company finds that any document is forged or altered, or that any information is deliberately misleading, it may stop the service immediately, refuse to submit the document, and inform the competent authorities where required or permitted by law. 9.4 Educational institutions or government authorities may cancel an admission or visa if they discover incorrect information, even after it is issued. The Company bears no responsibility for this. 10. Applications and Admission 10.1 The Company helps the student prepare and submit their application according to the institution’s requirements. 10.2 Admission decisions are made solely by the educational institution, according to its own criteria and discretion. The Company does not guarantee admission and cannot influence the institution’s decision. 10.3 Admission may be conditional on academic, language, financial or medical requirements. Meeting these conditions is the student’s responsibility. 10.4 Any estimate the Company gives about admission chances or timelines is not a guarantee or commitment. 10.5 Rejection of an application by an institution is not a breach by the Company. The student may ask the Company for help applying to another institution. 11. Visas, Student Passes and Immigration 11.1 Decisions on study passes, visas, entry and residence permits are made solely by the competent government authorities. Student Pass applications are normally submitted through the educational institution according to the approved procedures. 11.2 The Company’s role is limited to administrative assistance in preparing documents and following up the application. The Company does not guarantee the issuance of any visa or pass or the time it takes. 11.3 The student is responsible for meeting immigration requirements, including passport validity, medical examination and insurance, and for complying with the conditions of the pass once issued. 11.4 Refusal, delay or cancellation of any visa or pass is a decision of the competent authority and is not a breach by the Company. 12. Fees and Costs 12.1 The Company’s services described in clause 3 are completely free for the student. The Company does not charge the student any fee for them. 12.2 The student bears all external costs charged by third parties, and any actual costs arising from special requests or changes the student asks for after a service has been carried out. The Company will inform the student of such costs in advance and will not act on any request that involves a cost without the student’s approval. 12.3 Third parties set their own costs, which may change without notice. Their payment and refund terms are governed by their own policies. 13. Payments Received on the Student’s Behalf 13.1 The student may pay external costs directly to the relevant party. 13.2 If the student is unable to pay directly, they may ask the Company to receive the amount and transfer it on their behalf. In that case: • The Company receives the amount only through its official channels and issues the student a receipt. • The Company transfers the amount to the relevant party within a reasonable time and provides the student with proof of transfer. • The amount is used only for the purpose for which it was paid. • The student bears bank transfer charges and exchange rate differences unless otherwise agreed. 13.3 Once transferred to the relevant party, any refund is subject to that party’s policy, and the Company will help the student follow up the refund request. Amounts the Company has received but not yet transferred will be returned to the student in full, less any actual transfer charges, if the student cancels the request before transfer. 13.4 The Company is not responsible for amounts paid to accounts or persons it has not authorised. The Company will only request payments through its official channels listed in clause 27. 14. Cancellation 14.1 The student may stop the service at any time by notifying the Company, at no charge from the Company. 14.2 Stopping the service with the Company does not automatically cancel any application submitted to an institution or government authority, or any obligation to a third party (such as a tenancy agreement). The student may ask the Company for help notifying those parties. 14.3 Amounts received on the student’s behalf are dealt with under clause 13.3. 15. Accommodation, Reception, Transport and Post-Arrival Services 15.1 The Company itself coordinates these services as agreed with the student. 15.2 The tenancy agreement is between the student and the landlord or letting party. Deposits, rent, termination and maintenance are governed by that agreement. 15.3 The student must provide correct flight details sufficiently before arrival and inform the Company of any change. The Company is not responsible if reception cannot take place due to incorrect details or an unreported change. 15.4 Telecommunications, insurance and banking services are provided by their respective providers and are subject to their own terms and costs. 16. Delays Caused by Third Parties 16.1 The Company is not responsible for any delay, error, or change in procedures, requirements or decisions by educational institutions, government authorities, embassies, airlines or any third party. 16.2 Timelines given by the Company are estimates and are not commitments. 17. Limitation of Liability 17.1 To the extent permitted by applicable law, the Company is not liable for any indirect or consequential loss, including a lost study opportunity or financial loss resulting from third-party decisions or the student’s own decisions. 17.2 Nothing in these Terms excludes the Company’s liability for fraud, gross negligence or wilful misconduct, or any liability that cannot be excluded by law, nor affects any mandatory consumer rights. 18. Changes to Services The Company may modify, suspend or add services. No change affects a service already being carried out for a student, unless required by law or a third-party decision, in which case the Company will inform the student. 19. Communication 19.1 The student agrees that the Company may contact them by email, phone or WhatsApp for the purpose of providing the services. 19.2 The Company’s only official channels are those listed in clause 27. The Company is not responsible for dealings through other channels or with persons impersonating it. 19.3 Service-related communication is not consent to marketing messages, which are governed by the Privacy Policy. 20. Intellectual Property and Website Use 20.1 All website content, including text, designs, logos, guides and forms, is owned by or licensed to the Company. It may be used for personal, non-commercial purposes only, and may not be copied, republished or used commercially without prior written permission. 20.2 Names and logos of educational institutions shown on the website belong to their respective owners. 20.3 Website content is general guidance and is not advice specific to any user’s situation. The Company aims to keep the website available but does not guarantee it will be error-free or uninterrupted. 21. Prohibited Activities Users and students must not: • Provide forged or misleading information or documents, or impersonate any person or entity. • Use the website or services for any unlawful purpose. • Attempt to hack, disrupt or gain unauthorised access to the website, its systems or data, or scrape its data. • Abuse or threaten the Company’s staff or representatives. • Use website content in breach of clause 20. 22. Suspension or Termination 22.1 The Company may suspend or terminate the service by notice to the student if the student materially breaches their obligations, provides forged or misleading information or documents, engages in any prohibited activity, or if providing the service becomes unlawful or impossible. 22.2 Amounts received on the student’s behalf are dealt with under clause 13.3. 22.3 Clauses which by their nature survive termination remain in force, including limitation of liability, intellectual property, governing law and dispute resolution. 23. Force Majeure The Company is not liable for any delay or failure caused by circumstances beyond its reasonable control, including natural disasters, pandemics, wars, government decisions, border closures, visa suspensions, closure of educational institutions, and system or communication outages. The Company will inform the student of the circumstance and its expected effect as soon as possible. 24. Governing Law and Disputes 24.1 These Terms are governed by and construed in accordance with the laws of Malaysia. 24.2 The parties will try to resolve any dispute amicably. The student should send a written complaint to the Company’s official email, and the Company will respond within a reasonable time. 24.3 If amicable resolution fails, the courts of Kuala Lumpur, Malaysia, have jurisdiction, without prejudice to the student’s right to approach the competent consumer protection bodies under the law. 25. Changes to These Terms Any amended version of these Terms will be published on the website with an updated “Last updated” date. The Company will inform current students of material changes. Changes will not apply retroactively to services already being carried out without the student’s consent. 26. General 26.1 If any provision of these Terms is found invalid or unenforceable, it will be modified only to the extent necessary, and the remaining provisions remain in force. 26.2 The Company’s failure to exercise any right is not a waiver of it. 26.3 These Terms are available in Arabic and English. In case of any conflict between the two versions, the English version prevails. 27. Contact Details • Company: MADA EDUCATION SERVICES SDN.
